1. Introduction

Welcome to zmeu.ai ("zmeu.ai", "we", "us", "our").

These Terms of Service ("Terms") govern your access to and use of the zmeu.ai platform, website, and related services (the "Service").

By creating an account or using the Service, you agree to these Terms.

If you do not agree, you must not use the Service.

2. Description of Service

zmeu.ai provides an AI-powered platform that enables businesses to:

  • Generate social media content (images, captions, posts)
  • Manage brand assets
  • Schedule and publish posts
  • Connect and publish to Facebook Pages and Instagram Business accounts via Meta APIs

The Service is intended for businesses and professional use. Some features are experimental, beta, prototype, or dependent on third-party AI, publishing, payment, and infrastructure providers.

3. Eligibility

You must:

  • Be at least 18 years old
  • Have the authority to manage the connected Facebook Page or Instagram account
  • Use the Service in compliance with applicable laws and platform policies (including Meta policies)

You are responsible for maintaining the confidentiality of your login credentials.

4. User Responsibilities

You are solely responsible for:

  • All content generated, edited, or published through your account
  • Ensuring you have rights to uploaded images and brand assets
  • Compliance with Instagram, Facebook, and advertising regulations
  • Reviewing AI-generated content before publishing

zmeu.ai does not guarantee that generated content is legally compliant, factually accurate, suitable for your intended use, or free from intellectual property conflicts. You must review all content, claims, offers, prices, health or performance statements, and advertising materials before use or publication.

5. Publishing & Meta Integration

When connecting your Facebook or Instagram account:

  • You authorize zmeu.ai to access necessary data via Meta APIs.
  • Content is published only to accounts you authorize.
  • You may disconnect Meta access at any time through your Meta account settings.
  • You remain responsible for all content posted via your accounts.

zmeu.ai is not affiliated with or endorsed by Meta Platforms, Inc.

6. AI-Generated Content Disclaimer

The Service uses artificial intelligence to generate content.

AI-generated content:

  • May not always be accurate or appropriate.
  • May require human review and editing.
  • Is provided "as is".

You are responsible for reviewing and approving all content before publishing or using it commercially. AI outputs may be incomplete, inaccurate, offensive, infringing, or unsuitable.

zmeu.ai is not liable for damages, claims, losses, takedowns, rejected ads, account penalties, or business consequences arising from your use of AI-generated content.

7. Prohibited Use

You may not use the Service to:

  • Post unlawful, harmful, or fraudulent content
  • Violate intellectual property rights
  • Send spam or automated mass posting without review
  • Misrepresent products or services
  • Generate or publish deceptive, defamatory, hateful, adult, illegal, or harmful material
  • Impersonate people, brands, or organizations without authorization
  • Upload content you do not have permission to use
  • Use the Service to create content that violates advertising, consumer protection, or platform rules
  • Violate Meta's Platform Policies
  • Attempt to disrupt or reverse-engineer the Service

We reserve the right to investigate, block, remove content, suspend, delete, or terminate subscriptions, accounts, workspaces, or access without refund where we believe there is misuse, legal risk, security risk, non-payment, provider-policy risk, chargeback abuse, or violation of these Terms or applicable law.

8. Payments & Subscriptions

If you purchase a subscription:

  • Fees are billed according to your selected plan.
  • Payments are non-refundable unless required by law.
  • We may change pricing, credits, usage limits, plan packaging, or feature availability.
  • Failure to pay may result in suspension of access.

Our pricing and credit model depends on third-party service-provider costs, including AI model providers, video providers, voice providers, hosting, storage, rendering, publishing, and payment providers. If those provider prices, terms, limits, taxes, exchange rates, or availability change, we may adjust our pricing, credits, limits, included usage, or plan structure at any time. Changes may apply immediately where needed to protect service continuity, prevent abuse, or reflect provider cost changes.

Third-party payment processors may handle billing information.

9. Account Termination

You may delete your account at any time.

We may suspend or terminate accounts that:

  • Violate these Terms
  • Abuse the Service
  • Create security risks
  • Engage in prohibited activity
  • Create legal, regulatory, platform-policy, billing, or provider-risk issues
  • Use content, prompts, or integrations in a way that could harm zmeu.ai or other users

Upon termination, access to the Service will cease. We may delete or restrict access to accounts, subscriptions, generated assets, connected integrations, jobs, schedules, and stored content, subject to legally required retention.

10. Intellectual Property

zmeu.ai retains ownership of:

  • Platform software
  • AI systems
  • Design and branding
  • Website content

You retain ownership of:

  • Uploaded brand assets
  • Your original content
  • Your product photos, logos, prompts, campaigns, and brand materials

You own the generated outputs created for your account or workspace, subject to your compliance with applicable laws, these Terms, provider policies, and third-party rights.

We do not claim ownership of your uploaded content, brand materials, prompts, generated outputs, captions, campaigns, or scheduled posts. We do not sell, rent, license, or share your private customer content with third parties for their advertising, resale, or unrelated commercial use.

We may process your content only as needed to provide, secure, operate, support, analyze, and improve the Service for your account or workspace. This may include processing by third-party infrastructure, AI, hosting, storage, analytics, payment, and publishing providers that help us operate the Service.

We do not use your private customer content in our public marketing or external case studies without your permission.

11. Limitation of Liability

To the maximum extent permitted by law:

zmeu.ai shall not be liable for:

  • Indirect or consequential damages
  • Loss of profits or revenue
  • Loss of business opportunities
  • Loss, corruption, delay, or unavailability of data or content
  • Claims related to your content, products, offers, advertising, or legal compliance
  • Account suspensions by Meta
  • API outages or third-party failures
  • Provider price changes, provider limits, provider downtime, or discontinued provider features

The Service is provided "as is" and "as available" without warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted access, output quality, commercial results, or legal compliance.

To the maximum extent permitted by law, our total liability for any claim related to the Service is limited to the amount you paid to zmeu.ai for the Service in the three months before the event giving rise to the claim, or CHF 100 if you have not paid us.

12. Availability & API Dependency

The Service depends on third-party APIs and providers, including social media platforms, AI model providers, video providers, voice providers, hosting providers, payment processors, and storage providers.

We do not guarantee:

  • Continuous availability
  • Uninterrupted publishing
  • Permanent API access
  • Stable provider pricing, provider terms, provider output quality, or provider limits

Changes in third-party platform policies, provider pricing, quotas, terms, quality, availability, or technical behavior may impact functionality, pricing, credits, or access.

13. Privacy

Your use of the Service is also governed by our Privacy Policy:

14. Changes to These Terms

We may update these Terms from time to time.

Continued use of the Service constitutes acceptance of updated Terms.

15. Governing Law

These Terms shall be governed by the laws of Switzerland, without regard to conflict of law principles.
